Short definition

The question of whether casino winnings are taxable income for the player. In Estonia this generally depends on whether the operator is licensed inside or outside the European Economic Area.

Taxation of winnings is the question of whether winnings from a casino must be declared as income and whether income tax has to be paid on them. In Estonia the answer depends above all on where the gambling operator that paid the winnings is licensed.

When casino winnings are taxable

Under the Estonian Income Tax Act, winnings received from an operator licensed in Estonia or another European Economic Area country are generally not taxable. For such winnings the player usually does not have to declare or pay anything, because the operator pays taxes on its own activity. Neither the size of the win nor the type of game – slot, live table or sports betting – generally changes this principle.

The situation is different if the operator works outside the EEA, for example under a licence from a Caribbean country. Winnings from such an operator are generally taxable income that must be entered in the individual income tax return. The exact rules and any exceptions are explained by the Estonian Tax and Customs Board on its website emta.ee. Since laws change, it is always worth checking the current information before filing.

How this affects your withdrawal

Taxation does not change the technical course of a withdrawal: the casino pays out the winnings in the same way whether or not they are taxable for the player. It does, however, affect what you need to do after the money arrives. If you play at a casino licensed in Estonia or the EEA, the winnings generally stay with you in full. If you play at a site licensed outside the EEA, you have to allow for part of the winnings going to income tax.

With tax-free winnings you do not have to prove anything to the bank or the casino, but when a larger amount arrives the bank may ask on its own where the money came from. In that case a statement from your casino account or a confirmation of the withdrawal helps.

That is why the casino's licence is a practical selection criterion for tax purposes too. You can see casinos with an Estonian licence in the list of Estonian-licensed casinos.

What to check

  • Look in the casino's website footer or terms and conditions to see which country's licence it holds and who the operator is.
  • Keep statements of your deposits and withdrawals, especially if you play with an operator outside the EEA.
  • With a large win, for example a progressive jackpot, check the tax question before you use the money further.
  • Note that with a large withdrawal the casino or bank may ask about the source of funds – that is an anti-money laundering question, not a tax one.

Common misconceptions

One common belief is that all casino winnings are tax-free in Estonia. In fact the exemption generally applies only to operators licensed within the EEA. Another misconception is that the bank reports every win to the tax authority and the tax is calculated automatically – declaring winnings from a non-EEA operator is generally the player's own responsibility. A third source of confusion arises when several companies with different licences operate under the same brand: what matters is the operator your account is actually with.

Should you worry about tax on a win?

For most Estonian players who play at a casino with a local or EEA licence, winnings generally create no tax liability. If you are unsure, ask EMTA directly – that is simpler than filing a corrected return later. And remember that a win is chance, not income: play only with an amount you can afford to lose, and if needed see the responsible gambling page or contact the helpline 15410.

21+ Gambling is intended for players aged 21 and over only. A fast withdrawal does not make gambling a safe source of income. Only play with money you can afford to lose. If needed, set self-limits or seek help: responsible gambling.
